**TERMS AND CONDITIONS OF USE**

THESE TERMS APPLY TO YOUR ACCESS TO AND USE OF WEATHER 225 MEDIA’S WEBSITE, MOBILE APPLICATIONS, ROKU APPLICATIONS, CONNECTED TELEVISION APPLICATIONS, DESKTOP APPLICATIONS, STREAMING SERVICES, SOCIAL-MEDIA CONTENT, VIDEO CONTENT, WEATHER INFORMATION, AND OTHER WEATHER 225 MEDIA SERVICES.
By accessing or using any Weather 225 Media service, you acknowledge that you have read, understood, and agree to these Terms and Conditions of Use. If you do not agree to these Terms, please do not access or use the Services.
1. DEFINITIONS AND COVERED SERVICES
Weather 225 Media is referred to in these Terms as “Weather 225,” “we,” “us,” or “our.”

- Weather forecasts, radar information, weather graphics, maps, alerts, observations, articles, written updates, social-media posts, videos, photographs, audio, and other media.
- Weather 225-branded programs, productions, features, tools, and related services.
- Any other content or service made available by or on behalf of Weather 225 Media.
2. ACCEPTANCE OF TERMS
By accessing, viewing, downloading, installing, or using the Services, you agree to comply with these Terms and all applicable laws and regulations.
If you do not agree with these Terms, you are prohibited from using or accessing the Services.
You are responsible for ensuring that your use of the Services complies with all laws and regulations applicable to you.
3. LIMITED USE LICENSE
Subject to your compliance with these Terms, Weather 225 grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable permission to access and use the Services for personal, non-commercial, and lawful purposes.

- Attempt to decompile, disassemble, reverse engineer, or discover the source code or underlying technology of Weather 225 software or applications.
- Remove, alter, obscure, or bypass copyright, trademark, attribution, proprietary, or other legal notices.
- Use bots, scraping tools, automated systems, or similar methods to extract or collect content from the Services.
- Transfer, sublicense, or provide access to Weather 225 content in violation of these Terms.
Any permission granted under this section terminates if you violate these Terms. Weather 225 may also terminate or restrict this permission when reasonably necessary. Upon termination, you must stop using the Services and delete unauthorized copies of Weather 225 content in your possession or control.
4. ACCEPTABLE USE

- To make safety-related decisions based solely on Weather 225 content.
Weather 225 may suspend, restrict, or terminate access to any Service for violations of these Terms, security concerns, technical reasons, or other reasonable operational purposes.
5. STREAMING, BROADCASTS, AND SERVICE AVAILABILITY
The Services may contain live, recorded, replayed, automated, delayed, cached, time-shifted, edited, or otherwise processed audio and video content.
Weather 225 does not guarantee that any Service or broadcast will be continuously available, uninterrupted, secure, timely, error-free, or delivered in real time.
Availability and performance may be affected by internet connectivity, device compatibility, software, hosting providers, content-delivery networks, application stores, Roku or other platform policies, maintenance, technical failures, power outages, severe weather, third-party providers, or circumstances outside our reasonable control.
A broadcast labeled “live” may still experience transmission, processing, network, platform, or other delays.
Weather 225 may modify, suspend, discontinue, replace, or limit any portion of the Services at any time, with or without notice.
6. DELAYED BROADCASTS AND TIME-SENSITIVE INFORMATION
Weather 225 may provide weather broadcasts, forecasts, radar information, updates, graphics, alerts, or other content that is delayed, recorded, replayed, time-shifted, cached, processed, or otherwise not presented in real time.
By using the Services, you acknowledge and agree that:
- Weather 225 is not responsible for your reliance on a delayed, recorded, interrupted, replayed, or otherwise non-real-time broadcast.
- Weather 225 does not guarantee that information will be current, complete, accurate, or available when you view it.
- Delays may result from streaming platforms, internet service providers, device processing, application performance, content-delivery systems, transmission systems, or other technical factors.
- A delayed broadcast may not reflect current weather conditions, current warnings, or the latest forecast.
- You are responsible for independently verifying current conditions and official warnings before making safety-related decisions.
FOR IMMEDIATE OR POTENTIALLY LIFE-THREATENING WEATHER INFORMATION, DO NOT RELY SOLELY ON WEATHER 225. Monitor official emergency communications, local authorities, the National Weather Service, NOAA Weather Radio, and other appropriate emergency-alert sources.
7. WEATHER INFORMATION AND CONTENT DISCLAIMER
Weather forecasts, observations, radar data, weather graphics, automated alerts, videos, articles, written updates, social-media posts, and other materials are provided for general informational and educational purposes.
Weather information may contain technical, typographical, photographic, computational, or other errors or omissions. Weather conditions can change rapidly.
Weather 225 does not warrant or represent that any information is accurate, complete, current, reliable, timely, uninterrupted, or suitable for a particular purpose. Weather 225 does not guarantee any particular forecast outcome, result, or level of service.
You are responsible for evaluating information and taking appropriate precautions.
Nothing in the Services constitutes professional emergency-management, medical, legal, financial, or other professional advice.
Professional Advice Disclaimer. Weather 225 content is provided for general informational and educational purposes only and does not constitute professional advice or a professional recommendation of any kind. Weather 225 does not provide emergency-management, public-safety, medical, legal, financial, insurance, engineering, aviation, transportation, or other professional advice or services. 8. INDEPENDENT WEATHER COVERAGE
Weather 225 Media is an independent weather coverage provider.
Unless specifically stated otherwise, Weather 225 is not a government agency and is not an official representative of the National Weather Service, NOAA, FEMA, or any other government agency.
Weather 225 content should not be interpreted as an official government warning, order, instruction, or emergency communication.
Official warnings and emergency instructions should be obtained from appropriate government and emergency-management authorities.
9. DISCLAIMER OF WARRANTIES
THE SERVICES AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEATHER 225 DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, AVAILABILITY, QUIET ENJOYMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
WEATHER 225 DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, BE SECURE, BE FREE FROM DEFECTS OR HARMFUL CODE, OR PRODUCE PARTICULAR RESULTS.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEATHER 225 MEDIA AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, PARTNERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OPPORTUNITY, OR OTHER INDIRECT LOSSES ARISING OUT OF OR RELATED TO:
- Your use of, or inability to use, the Services.
- Any delayed, interrupted, recorded, replayed, or time-shifted broadcast.
- Your reliance on forecasts, radar, alerts, graphics, weather information, or other content.
- Missed, delayed, incomplete, inaccurate, or unavailable information.
- Severe weather, emergencies, power outages, network failures, platform outages, technical failures, or events outside Weather 225’s reasonable control.
- Your use of Roku, a mobile device, an application store, YouTube, a streaming provider, an internet service provider, or another third-party service.
This section is intended to apply only to the fullest extent permitted by applicable law. It does not exclude or limit liability for fraud, intentional misconduct, or any other liability that cannot legally be excluded or limited.
Nothing in these Terms waives rights or protections that applicable law does not permit you to waive.
Because some jurisdictions do not allow certain warranty disclaimers or limitations of liability, some limitations may not apply to you.
11. THIRD-PARTY PLATFORMS, SERVICES, AND LINKS
The Services may be accessed through or contain links to third-party services, including Roku, Apple, Google, YouTube, application stores, internet service providers, hosting providers, social-media platforms, and other websites or services.
Weather 225 does not control and is not responsible for the content, accuracy, availability, security, policies, performance, or practices of third-party services.
The inclusion of a link or reference does not constitute an endorsement or approval by Weather 225.
Your use of a third-party platform may also be subject to that platform’s separate terms, privacy policy, licensing terms, and other requirements.
If a third-party platform is unavailable or changes its policies, Weather 225 may be unable to provide some or all Services through that platform.
12. DEVICE, INTERNET, AND DATA RESPONSIBILITY
You are responsible for obtaining and maintaining a compatible device, operating system, software, internet connection, mobile service, and any subscriptions or data plans needed to access the Services.

Weather 225 is not responsible for those charges, device failures, incompatibility, or connectivity problems.

All Weather 225 names, logos, trademarks, service marks, branding, graphics, videos, forecasts, written materials, designs, software, applications, broadcasts, and other content are owned by Weather 225 Media or used with permission and may be protected by copyright, trademark, and other applicable laws.
Except as expressly permitted by these Terms or in writing by Weather 225, no content may be copied, reproduced, modified, distributed, publicly displayed, publicly performed, sold, licensed, retransmitted, or used to create derivative works.
14. REVISIONS, ERRATA, AND CONTENT CHANGES
The Services may contain technical, typographical, photographic, programming, or other errors.
Weather 225 does not warrant that all content is accurate, complete, current, or free of errors.
Weather 225 may correct, update, remove, replace, or change any content, feature, application, graphic, forecast, video, or other material at any time without notice.
Weather 225 does not undertake an obligation to update any particular material or maintain any particular feature or Service.
15. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Weather 225 Media and its owners, officers, employees, contractors, contributors, affiliates, licensors, service providers, partners, and suppliers from and against claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use or misuse of the Services.

The Privacy Policy explains how Weather 225 may collect, use, disclose, retain, and protect personal information and other information associated with use of the Services.
The Privacy Policy is incorporated into these Terms by reference to the extent permitted by applicable law.
17. CHANGES TO THESE TERMS
Weather 225 may revise these Terms at any time.
Updated Terms may be posted on the Weather 225 website, within an application, or through another appropriate Service.
By continuing to access or use the Services after revised Terms are posted, you agree to be bound by the updated Terms, to the extent permitted by applicable law.
For material changes, Weather 225 may provide additional notice where reasonably appropriate.
18. TERMINATION
Weather 225 may suspend, restrict, or terminate your access to any Service at any time, with or without notice, if we reasonably believe that you have violated these Terms, created a security or legal risk, misused the Services, or otherwise used the Services in a manner that may harm Weather 225 or others.
Sections concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, and provisions that by their nature should survive termination will survive termination.
19. POWER LOSS / TECHNICAL FAILURE
Power Loss, Equipment Failure, and Technical Disruptions. Weather 225 is not responsible for interruptions, delays, outages, errors, loss of data, loss of broadcast, or inability to access the Services resulting from power outages, electrical failures, equipment failure, hardware or software malfunctions, internet or network outages, telecommunications failures, server or hosting failures, streaming or transmission failures, cybersecurity incidents, maintenance, system upgrades, severe weather, natural disasters, acts of God, third-party service interruptions, or other technical, operational, or infrastructure-related failures beyond Weather 225’s reasonable control.
Weather 225 does not guarantee that its broadcasts, websites, applications, radar, forecasts, alerts, graphics, videos, or other Services will remain continuously available during or following a power loss, technical failure, severe weather event, emergency, or other disruption. Users should not rely solely on Weather 225 as a source of emergency or life-safety information, particularly when the Service may be unavailable or experiencing technical difficulties.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
21. GOVERNING LAW
These Terms and any dispute relating to the Services shall be governed by the laws of the State of Arkansas, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

- Broadcasts may not be delivered in real time.
- Weather 225 is an independent weather coverage provider and is not a substitute for official emergency-alert sources.
- You should not rely solely on Weather 225 for emergency warnings or time-sensitive safety decisions.
- You are responsible for reviewing and complying with these Terms and Conditions.
